TERMS AND CONDITIONS

Please take the time to read the following terms and conditions. The information outlined in these terms and conditions can and/or will be used in the event of a discrepancy. The parties to this agreement include Bodyfuel Supplements Pty. Ltd. Trading as Flex24/7 Gym and the member detailed on the completed membership form.  By signing the Membership Form the Member agrees to have been provided with a copy of these Terms and Conditions. All members of Flex must be a minimum of 12 years of age. Members under 16 will need to be supervised by an adult when using the gym facilities. All membership agreements for children under 18 years of age are required to be authorized and signed by a parent/guardian.

Acknowledgement of Obligations, Risks & Injury

The Member acknowledges that any activity undertaken at Flex 24/7 Gym is dangerous and that by participating in such activity the Member is exposed to certain risks. The Member acknowledges that they are physically and medically sound to undertake any activity and agree to advise Flex 24/7 Gym if they become physically and/or medically unsound to participate in such activity. The Member understands that while participating in an activity:

• They may be injured, physically or mentally, or may die;
• Their personal property may be stolen, lost, or damaged;
• Other people participating in the activity may cause them injury or may steal or damage their property;
• The Member may cause injury to other persons or damage their property.

The Member participates in any activity at their sole risk and responsibility and the Member assumes responsibility for any injury, death or property loss or damage resulting from their participation in an activity. The Member releases, indemnifies and exempts Flex 24/7 Gym, its employees, agents and contractors, from and against all and any actions or claims which may be made by the Member or on the Member’s behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to the Member or their property whether by negligence, breach of contract or otherwise.

TURNSTILEGATE PENALTY

TURNSTILE GATE PENALITY. I agree, if I allow any non-member or member to the gym using my access key or pass, I would be liable to pay $150 turnstile gate penalty fee plus $15 for casual visit for each person and I would also be responsible for any loss, Steal or damages to the Gym by them. If I do not pay penalty charges on time, there would be 10% interest charges on the penalty fee each day. Please mind your personal belonging as we do not take responsibility if they get lost or stolen.

ENTRY REQUIREMENTS

I understand, it is compulsory to bring towel to the gym every time which means “No towel no training”. I would never come to the gym in workwear, work shoes, steel cap shoes, dirty clothes, thongs and dirty shoes. I shall always come to the gym in appropriate neat and clean gym clothing and shoes. I will always re-rack the weight after use, including repositioning equipment to correct place if removed. Flex 24/7 has the right to stop my access to the gym or cancel my membership straightway without giving any refund or notice period if the above written conditions are not followed.

To maintain health and safety, which is the most important thing as we all want to stay safe, healthy, and happy. It is the condition of your membership that you fully understand and abide the following conditions: – Use all equipment with proper knowledge to avoid injuries as we do not take responsibility for any kind of incident. Heavy weight plates to be stacked to the bottom of the weight tree. Do not bang or drop the weights rudely while using any equipment. Machines are not to be used when a ‘ Please Do not use’ tag is placed on them. Do not lean against or touch mirrors. Towels to be used/Placed on all resistance machines ‘seats and floormats. Equipment to be shared if requested by another person.

Spray Bottles and clothes to be used to wipe out all the Machines after use. Water spillages either on the gym floor or in the bathroom needs to be notify at reception or moped. Covered shoes to be always worn. All belongings to be left in dedicated lockers. Weight pins to be removed from all resistance machines after use. Assess the machine before using. In case of a faulty machine please advise the Manager or receptionist on duty.

Membership

Membership at Flex24/7Gym entitles the Member to work out as many times as they wish in a given period. Flex reserves the right to make changes to exercise equipment supplied at any time. To ascertain exactly what a particular facility provides please enquire at the facility directly. There may be additional fees charged to access these facilities and services. Flex also reserves the right to make changes to the opening hours and pricing.

MEMBERSHIP KEY TAGS

Upon joining Flex24/7 Gym, a photo of the member will be taken for security reasons relating to safety of all members and patrons. This photograph will not be used for any other purpose and will be store in Flex24/7 Gym ’s database system. The member will be issued Member’s Name Signature Date one membership key tag will be responsible for it. Membership Key tag replacement fee is $20.00. All members must present a membership key tag upon entry to Flex24/7 Gym. Membership key tag scan is compulsory for security and insurance purposes. If a member does not have their membership key tag with them upon entering Flex 24/7 Gym, the member will be charged a casual visit rate as an entry fee. In case of member let other person to use of their membership key tag, immediately with no warning their membership can be cancelled, and no monies will be refunded, also turnstile gate penalty of $150 plus casual rates would be charged. The member and other person who used member’s membership key tag can be banned permanently from using and attending Flex 24/7 Gym.

UPFRONT MEMBERSHIP PAYMENT

 The member understands that if a membership payment is made upfront. The member will not be entitled to refund of any monies paid in case of membership cancellation. Upfront membership cannot be transferred or refunded.

DIRECT DEBIT MEMBERSHIPS

A member who applies for direct debit membership by completing the online application form, request and authorizes to directly debit the member’s nominated bank account. The member understands that a Admin Fee or Joining Fee applies to direct debit memberships. Flex 24/7 Gym has two direct debit options, which a member can choose from:

1. An ongoing contract with minimum 12 months term. This is debited on weekly or fortnightly basis. Once the member has completed their 12 months contract, their membership will continue to be ongoing. Only active period of membership would be counted in 12 months period. Suspension period would not be counted in 12 months term and the 12 months term would be extended accordingly. If the member wishes to cancel their membership within their contract period, an early cancellation fee of $150 shall apply. The member will be required to complete a direct debit cancellation form and lodge it with Flex 24/7 Gym at least 28 days prior to the cancellation date. The member will not be required to pay the exit fee if they cancel their membership after completion of 12 months contract. Member must pay membership fee as normal during 28 days’ notice period. No verbal notices are accepted.
   

2. An ongoing no lock-in contract. This is debited on weekly or fortnightly basis. This membership is ongoing with no minimum term. If the member wishes to cancel their membership, they will be required to send email @ flex247gymepping@gmail.com at least 28 days prior to the cancelation date. Member must pay membership fee as normal during 28 days’ notice period. No verbal notices are accepted. If a member initiates the cancellation of their membership but later changes their mind during cancellation period and wishes to continue, requiring them to pay the admin or joining fees again.
   

Direct Debit is an automatic weekly or fortnightly deduction that will be maintained unless the member provides authorisation to Flex 24/7 Gym to cancel the Direct Debit. All direct debit memberships have Admin fee. If the Member’s Direct Debit is dishonoured by their financial institution, Flex 24/7 will recover outstanding balances together with any administration fee on next Direct Debit date. If the member has an outstanding overdue amount on their direct debit membership, their access to Flex 24/7 will be restricted until outstanding amount has been paid in full. There is dishonour fee or penalty of $10 on every unsuccessful direct debit payment due to any reason.

MEMBERSHIP SUSPENSION

Please note that the following is subject to a member paying the standard fee for their Direct Debit Membership: The member may suspend their membership for minimum period of 2 weeks and maximum period of 4 weeks in a year. The member is required to notify Flex 24/7 in writing or in person at least 7 days prior to required suspension date.

Transfer Membership

Membership can be transferred to new member if it is not Promotional Membership by paying $90 transfer Fee.

PROMOTIONAL VIDEOS AND PHOTOGRAPHY

 I have no objection if Flex 24/7 Gym use my shotted videos or photographs at their Gym for their online promotions.

Lockers

Lockers are available at Flex 24/7 Gym. Members need to ask the key from reception and swap with their valuable belonging. After finish they can return the locker’s key at reception and get their belonging back. Locker’s key is not allowed to take outside the gym. In case member lost the locker’s key, he will get charge for all the expenses.

Sauna

Every Member is allowed 25 MINUTES MAX in 24 hours once sauna turned is on. You agree to wear appropriate clothes in sauna and carry a towel in Sauna. Electronics equipment ae not allowed in sauna. Seek medical advice before sitting in sauna.

Boxing/MMA

• LIGHT SPARRING ONLY
• NO AIMING AT YOUR OPPONENT’S HEAD
• SHOES OFF AT ALL TIMES
• LIGHT TAKEDOWNS IN THE RING
• YOU ARE LIABLE FOR YOUR OWN ACTIONS IN THE RING

Note: Flex24/7 gym is not taking any responsibility any injury or any incident happened in MMA cage.

PlayStation Area:

Members are only allowed to get the controller to play PlayStation if they swap their valuable belonging with controller at reception. After play they can return controller back at reception and get their belonging back. In case they lost/steal controller they will be get charge for all the expenses. Same as controller for Pilates Tv.

Note

• Any items of lost property will be held by Flex24/7 Gym for one week and will then be thrown out or donated to various charities.
• All Members are responsible for their own vehicles in car park area. Flex is not taking any responsibility for any damage.
• Only our authorized PTs are allowed to conduct PT sessions.
• There is no cooling off period.
• No Money will be refunded in case you change your mind.
• Any damage done to Flex 24/7 Gym property or equipment will be followed by Legal Action against the person involved.
• Management keeps the right to refuse membership.
• No misbehaviour will be tolerated with staff or any other members at flex 24/7 gym. Management can cancel the membership straight way without giving any notice.

I acknowledge that I have read and understand the terms and conditions of this agreement. I, certify that I willingly participate on my own free will in exercise(s) at Flex 24/7 Gym Epping. I warrant that I am physically and mentally sound to proceed with a program of exercises. I acknowledge that at all times while on Flex 24/7 Gym Epping’s premises, both my property and my person shall be at my own risk. I shall not hold Flex 24/7 Gym Epping staff or contractors responsible or liable for any loss of property or personal injury. I acknowledge that I have read the membership Terms and Conditions and have agreed to abide by them. I agree to fulfill these financial commitments even in the event of me not attending Flex 24/7 Gym Epping or utilising its services.

MEDICAL CONDITIONS

 I hereby agree that I have informed Flex 24/7 Gym Epping of my following medical conditions (if any) and hold no claim against Flex 24/7 Gym Epping in the event of injury or death.
